I regularly represent health care providers, marketers, and health care organizations accused of or under investigation for health care fraud and violations of the anti-kickback statute. Recently, I represented the owner of a pharmacy. The owner was charged with engaging in a conspiracy to pay kickbacks in exchange for referrals, in addition to other crimes. The owner was the last individual in the conspiracy to be charged. All co-conspirators had pled guilty and were sentenced to prison. My client was sentenced to home confinement and absolutely no jail time. This was only possible after months of zealous advocacy on behalf of my client. It was a great result and the right resolution for my client.
This lesson is that you do not have to accept the first offer made by the government. You do not have to accept unreasonable loss figures. You do not have to plead guilty if you didn’t do anything wrong.
