Hello, I am Marissel Descalzo

I am a trial attorney and focus my practice on complex criminal and civil litigation in both federal and state court. I have participated in numerous trials to verdict.  I represent individuals and organizations accused of fraud and/or deceptive practices, assist and advise organizations on corporate governance and compliance matters. I represent doctors, hospitals, skilled nursing facilities, pharmacies, and other health care providers, during government investigations and defend them in qui tam (whistle-blower) actions. I also regularly counsel companies from a variety of industries on the adoption and operation of their compliance programs and related due diligence issues.

Prior Work

  • Indictment Dismissed – United States v. D.B., Case No. 22-cv-20013
  • Convinced Federal Government – Declined to Prosecute owner of laboratory that was accused of conducting medically unnecessary tests
  • Judge granted acquittal during trial – United States v. J.P., Case No. 21-cr-20301
  • Represented an individual accused and convicted of fraud and grand theft through an appeal where the conviction was reversed and the charges reduced to a misdemeanor
  • Represented a doctor under criminal investigation for receipt of kickbacks, the Government decided not to prosecute after several meetings and a presentation
  • Defended largest health care fraud prosecution through trial and secured mistrial on health care fraud count
  • Represented former Treasurer of Venezuela accused of money laundering and Foreign Corrupt Practices Act violations through trial
